We have in-depth knowledge and experience dealing with the wide range of issues which arise when companies face solvency issues, including:

  • Advising directors on compliance with their legal duties
  • Advising in relation to the full range of restructuring/insolvency options
  • Defending contested statutory demands and winding-up petitions
  • Negotiating settlements so as to allow the company to return to solvency without insolvency proceedings being instituted

Notable Experience

  • Advising a substantial construction group in relation to the winding-up of a subsidiary and subsequent calls on contruction bonds/indemnities, ultimately concluding in a complex settlement which allowed all relevant companies to remain solvent
  • Advising the directors of a secured lending business which had been historically mismanaged, including in relation to solvency issues and coordinating a strategy to minimise losses to stakeholders and rationalise the company's operations
  • Advising directors of various companies in ensuring compliance with their duties when faced with solvency issues, including in complex situations involving ongoing cash-flow management and engagement from lenders and private equity houses
