Ilana Baines and Michael Potts have collaborated with Lexis Nexis to produce detailed practice notes on how to deal with Dawn Raids and the powers available to authorities including the CMA, FCA, HSE, HMRC, ICO, police and SFO.

The potential for a dawn raid to be executed against a company is an everyday reality for many businesses given the increasing criminalisation of business practices, more regulatory criminal offences and the proliferation of money laundering laws and regulations. The prospect of an intervention by the UK authorities has increased recently particularly since the introduction of the corporate offences of failure to prevent bribery and failure to prevent tax evasion, along with the expansion of corporate criminal liability and the new offence of failure to prevent fraud introduced as a result of the Economic Crime and Corporate Transparency Act 2023.

Michael and Ilana provide useful guidance for dealing with raids by each of the authorities outlined above along with practical action plans and detailed response guidance for the entire business. They also provide useful insight into the newly introduced Digital Markets, Competition and Consumers Act 2024, which came into force in January 2025, and introduced a new digital markets regulation regime.
